These Terms of Use (“Terms”) govern your access to and use of the Brushbook website and services at https://www.brushbook.com (“Brushbook,” “we,” “us,” or “our”). By creating an account or using our services, you agree to these Terms. If you do not agree, do not use Brushbook.
1. Our services
Brushbook is a platform for art lovers to discover artworks, rate and review pieces, track what they have viewed, save favourites, and share their taste with others. We may update, suspend, or discontinue features at any time.
2. Eligibility and accounts
You must be at least 13 years old to use Brushbook. If you are between 13 and 18, you confirm that you have your parent or guardian's permission to use the service. You may sign in using a supported third-party provider (such as Google). You are responsible for activity under your account and for keeping your login credentials secure.
- Provide accurate information and keep your profile up to date.
- Notify us promptly at hello@brushbook.com if you suspect unauthorised access.
- Do not share your account or use another person’s account without permission.
You may request deletion of your account and all associated data by emailing hello@brushbook.com. We will process deletion requests within 30 days.
3. Your content
You may submit content such as reviews, ratings, notes, and other material (“User Content”). You retain ownership of your User Content. By posting it, you grant Brushbook a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute it solely to operate and promote the services.
You represent that you have the right to post your User Content and that it does not violate any law or third-party rights. We may remove content that we reasonably believe violates these Terms or is harmful to the community.
4. Acceptable use
You agree not to:
- Harass, abuse, or harm others or impersonate any person or entity.
- Post unlawful, defamatory, obscene, or infringing content.
- Scrape, crawl, or reverse-engineer the services without our written consent.
- Interfere with security, overload our systems, or distribute malware.
- Use the services for spam or unauthorised commercial solicitation.
5. Intellectual property
Brushbook’s name, branding, software, and site design are owned by us or our licensors. Artwork images, titles, and metadata may belong to third parties and are displayed for informational and educational purposes. Do not reuse site content outside what we expressly allow.
6. Third-party services
We rely on third-party providers (for example authentication, hosting, analytics, and database services). Your use of those features may be subject to their terms and privacy policies. We are not responsible for third-party websites linked from Brushbook.
7. Disclaimers
Brushbook is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation. Reviews and ratings reflect user opinions, not professional advice.
8. Limitation of liability
To the fullest extent permitted by law, Brushbook and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the services. Our total liability for any claim relating to the services is limited to the greater of (a) amounts you paid us in the twelve months before the claim or (b) one hundred pounds sterling (£100).
9. Termination
You may stop using Brushbook at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe termination is necessary to protect the service or other users. Sections that by their nature should survive termination will survive.
10. Changes
We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Continued use after changes take effect constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Courts in England and Wales have exclusive jurisdiction, subject to any mandatory consumer protections in your country of residence.
12. Data protection
Your personal data is processed in accordance with our Privacy Policy at https://www.brushbook.com/privacy. If you are located in the European Economic Area or United Kingdom, you have rights under applicable data protection law including the right to access, correct, and delete your personal data.
